SUBJECT: RE-ADOPTION
AND AMENDMENT TO THE “SIGNS IN
THE RIGHT OF WAY” POLICY |

WHEREAS, by
Resolution dated June 24, 1996, the Board of County Road Commissioners of the
County of Ingham adopted Board Policy #BP-224 dealing with signs in the road
right of way; and WHEREAS, there was
subsequently enacted in 1996, P.A. 299, permitting the Michigan Department of
Transportation to, in certain circumstances, authorize tourist oriented
activity directional signs for tourist-oriented activities on state highways
under the direction and authority of MDOT; and WHEREAS, MDOT has
requested local road commissions to assist in the implementation of the
placement of tourist oriented directional signs in certain circumstances
where the placement of same on county roads would be appropriate; and WHEREAS, the Board
of Ingham County Road Commissioners believes it is appropriate to permit the
placement of such signs in certain circumstances. NOW THEREFORE BE IT
RESOLVED, that the Board of Ingham County Road Commissioners (Ingham County
Road Commission) does hereby adopt the following “Signs in the Right of Way”
policy, superseding policy number #BP-219 and all prior policies dealing with
signs in the right of way for Ingham County roads. The Board prohibits the placement of any sign(s) in the traveled portion of the roadway, any sign(s) in and upon the shoulders of the roadway, any sign(s) attached to Road Commission sign posts or any location within the road right of way where the sign could restrict the clear vision or be a hazard, EXCEPT that the Board, in its discretion, may consider and grant approval for “tourist oriented directional signs” for “tourist oriented activity” as those terms are used in 1996 P.A. 299, but only upon BOTH of the following conditions: _____________________________________________________________________________ ADOPTED BY THE BOARD OF INGHAM COUNTY ROAD COMMISSIONERS ON

A.
The State Department of Transportation
has previously granted approval for “tourist oriented directional sign(s) for
the “tourist oriented activity” on roads under its jurisdiction. B.
The placement of additional “tourist oriented
directional sign(s)” upon County roads directing motorists to the “tourist
oriented activity” would reasonably assist motorists consistent with the
intent of 1996 P.A. 299. The Board authorizes removal (without notice) of any sign from the road right of way which restricts clear vision or which creates a hazard, upon being made aware of the vision restriction or hazard. Written
demand may be made upon the owner of the property where the sign is placed to
remove same and if not removed within thirty (30) days, may be then removed
and the expense for which shall be a charge to the owner of the property, as
authorized pursuant to MCL 247.187. This
policy shall become effective immediately and rescinds and supersedes Board
Policy #224 dated June 24, 1996, and any and all other prior policies and/or
resolutions regarding this subject. |
